Section 563 of the 2008 Consolidated Appropriations Act, Subtitle J, Secure Handling of Ammonium Nitrate ("Section 563"), Public Law 110–161
Published December 26, 2007. This amends the Homeland Security Act of 2002 by requiring the Department to "regulate the sale and transfer of ammonium nitrate by an ammonium nitrate facility ... to prevent the misappropriation or use of ammonium nitrate in an act of terrorism."
Proposed Rule: Ammonium Nitrate Security Program
Published August 3, 2011. This proposed rule would regulate the sale and transfer of ammonium nitrate pursuant to Section 563 of the 2008 Consolidated Appropriations Act, with the purpose of preventing the use of ammonium nitrate in an act of terrorism. This proposed rule sought comment on both proposed text for such a regulation and on several practical and legal issues integral to the development of an ANSP. Comments were accepted through December 3, 2011.
ANPRM: Secure Handling of Ammonium Nitrate Program
Published October 29, 2008. This Advance Notice of Proposed Rulemaking (ANPRM) sought comment on an amendment to the Homeland Security Act entitled, "Secure Handling of Ammonium Nitrate." Comments on the ANPRM were accepted through December 29, 2008.
Notice of Availability of Redacted Ammonium Nitrate Security Program Technical Assessments Report
Published June 3, 2019. CISA published a notice of availability of the Sandia National Laboratory’s (SNL) Redacted Ammonium Nitrate Security Program Technical Assessments Report in the Federal Register in connection with the proposed rule entitled “Ammonium Nitrate Security Program.” The redacted SNL report can be accessed in the Secure Handling of Ammonium Nitrate Program docket (DHS-2008-0076). Comments were accepted through September 3, 2019.
Notice of Public Meetings: Ammonium Nitrate Security Program
Published October 7, 2011. The Department held a series of public meetings to receive input on a notice of proposed rulemaking (NPRM) entitled "Ammonium Nitrate Security Program," and regarding the questions and issues raised in the NPRM, which was published in the Federal Register on August 3, 2011 (see above).
