CFATS PRA Notices for Comment


The Paperwork Reduction Act (PRA) requires federal agencies to take specific actions before requiring or requesting information from the public. This includes posting notices informing the public about new programs and policies and seeking comments from the public through information collection requests (ICR), which are published in the Federal Register. The Office of Management and Budget (OMB) manages this requirement and grants approval for requests of information.

These are the Federal Register notices and ICRs regarding the Chemical Facility Anti-Terrorism Standards (CFATS) program.

Information Collection Requests (ICR)

Chemical Security Assessment Tool (CSAT) ICR (1670-0007)

Current ICR Will Expire 7/31/2023

  • Complete information collection package and Notice of Action (Ref No. 201905-1670-001) issued by OMB to the Agency authorizing the revised burden estimates and authorizing CISA to collect information using approved instruments.
  • 30-Day Notice (84 FR 19929) to solicit comments for a revision to OMB Information Collection #1670-0007. In this notice, CISA responds to one commenter who submitted multiple comments in response to the 60-day notice and revises the burden associated with an instrument (Identification of Additional Facilities and Assets at Risk). Published May 7, 2019.
  • 60-Day Notice (84 FR 2558) to solicit comments for a revision to OMB Information Collection #1670-0007. This submission proposed to renew the information collection for an additional three years and update the burden estimates associated with collecting information in CSAT (i.e., User Registration, Top-Screen, Security Vulnerability Assessment, Site Security Plan and Alternative Security Program, etc.) for CFATS. Published February 7, 2019.

Previous ICR Expired on 7/31/2020 (Extended from the initial expiration date of 7/30/2019)

  • Complete information collection package and Notice of Action (Ref. No. 201604-1670-001) issued by OMB to the Department authorizing the revised burden estimates for the instruments based on data collected since 2012 on how the tools are used. The revised estimate also accounts for the updates that the Department made to the questionnaires in order to implement the improved tiering methodology and incorporate the DHS estimates of the efficiencies that will be gained by the new, streamlined questionnaires.   • 30-Day Notice (81 FR 21887) to solicit comments for a revision to OMB Information Collection #1670-0007. Published April 13, 2016.
  • 60-Day Notice (80 FR 72086) to solicit comments for a revision to OMB Information Collection #1670-0007. Published November 18, 2015.

Previous ICR Expired 7/31/2016 (Extended from the initial expiration date of 4/30/2016)

  • Complete information collection package and Notice of Action (Ref. No. 201303-1670-001) issued by OMB to the Department authorizing the revised burdens for the instruments based upon historical data since the implementation of the collection. Several of the instruments were refined to reflect the maturing regulatory program. The Chemical-Terrorism Vulnerability Information (CVI) Training and User Authorization instrument was removed from this collection and remains only in the CVI collection (see 1670-0015). Issued on October 11, 2014.
  • 30-Day Notice (78 FR 16694) to solicit comments for a revision to OMB Information Collection #1670-0007. Published March 18, 2013.
  • 60-Day Notice (77 FR 74678) to solicit comments for a revision to OMB Information Collection #1670-0007. Published December 17, 2012.

  • 60-Day Notice (74 FR 31459) to solicit comments for a revision to OMB Information Collection #1670-0007. Published July 1, 2009.

Previous ICR Expired 5/31/2011

  • Collection information collection package and Notice of Action (Ref. No. 200809-1670-002) issued by OMB to the Department authorizing the revised minor change to the CVI Authorization that did not affect the burden of the instrument. The minor change renamed the instrument to the CVI Training and Authorized User Application and removed the non-disclosure element in the instrument. Issued on October 24, 2008.
  • 30-Day Notice (73 FR 4886) to solicit comments for OMB Information Collection #1670-0007 (Helpdesk, User Registration, CVI Authorized User Training and Application, Top Screen, SVA, and SSP). Published January 28, 2008.
  • 60-Day Notice (72 FR 65757) to solicit comments for OMB Information Collection #1670-0007 (Helpdesk, User Registration, CVI Authorized User Training and Application, Top Screen, SVA, and SSP). Published November 23, 2007.

CFATS Personnel Surety Program ICR (1670-0029)

Current ICR Will Expire 5/31/2022

  • Complete information collection package and Notice of Action (Ref. No. 201806-1670-001) issued by OMB to the Agency authorizing the collection of information for the phased implementation of the CFATS Personnel Surety Program at all high-risk chemical facilities. Issued on May 23, 2019.
  • 30-Day Notice (83 FR 28244) to solicit comments for a revision to OMB Information Collection #1670-0029. This information collection will allow high-risk chemical facilities to implement the CFATS Personnel Surety Program on Tier 3 and 4 facilities. Published June 18, 2018.
  • 60-Day Notice (82 FR 61312) to solicit comments for a revision to OMB Information Collection #1670-0029. This information collection request notice is the first step in the process of gaining approval to allow high-risk chemical facilities to implement the CFATS Personnel Surety Program on Tier 3 and 4 facilities. In addition, this ICR notice revises the estimated number of annual respondents and the estimated time per respondent based upon historical data collected by the Department. Published December 27, 2017.

  • 60-Day Notice (78 FR 17680) to solicit comments for OMB Information Collection #1670-NEW (CFATS Personnel Surety Program). Under this notice, the Department revised its previously proposed collection of information to allow high-risk chemical facilities to comply with 6 CFR 27.230(a)(12)(iv) to implement "measures designed to identify people with terrorist ties." Published March 22, 2013.

Previous ICR was Withdrawn on 7/20/2012

  • Complete information collection package and Notice of Action (Ref. No. 201105-1670-002) issued by OMB acknowledging the withdrawal if the collection of information. Issued on July 20, 2012.
  • Paperwork Reduction Act (PRA) Notice (76 FR 34720) that (a) responds to comments received during the PRA 30-day comment period, and (b) notifies the public that the Office of Management and Budget is beginning its review of the PRA Information Collection Request for the CFATS Personnel Surety Program.

Chemical-terrorism Vulnerability Information (CVI) ICR (1670-0015)

  • CISA submitted ICR #1670-0015 to OMB on December 16, 2020 (Ref. No. 202012-1670-001). OMB’s policy is to extend the Agency’s authorization to collect information under the Information Collection that was set to expire in January 2021 in 30-day increments until OMB concludes its review of the ICR.
  • Correction to previously published 30-day notice (85 FR 48552). In this notice, CISA corrects the docket number published in the initial 30-day notice. This notice also extends the comment period to September 10, 2020, which is an additional 30 days after publication of the correction. Published on August 11, 2020.
  • 30-Day Notice (85 FR 43863) to solicit comments for OMB Information Collection #1670-0015 (Chemical-terrorism Vulnerability Information). In this notice, CISA requests comments on the minor update to the ICR burden described in the 60-day notice because no comments were submitted. Published on July 20, 2020.
  • 60-Day Notice (85 FR 17593) to solicit comments for OMB Information Collection #1670-0015 (Chemical-terrorism Vulnerability Information). This information collection will be used to manage the CVI program in support of CFATS and proposes one minor update in the ICR to increase the loaded average hourly wage rates of respondents based on updated wage and compensation data. Published on March 30, 2020.
