CFATS PRA Notices for Comment

The Paperwork Reduction Act (PRA) requires Federal agencies to take specific actions before requiring or requesting information from the public. This includes posting notices informing the public about new programs and policies and seeking comments from the public through information collection requests (ICR), which are published in the Federal Register. The Office of Management and Budget (OMB) manages this requirement and grants approval for requests of information.

These are the DHS Federal Register notices and ICRs regarding the CFATS program.

Notices Posted in the Federal Register

CFATS Suspension and Modification of Certain Submission Requirements
Published July 20, 2016. This notice informed the public of the Department’s actions to implement an improved tiering methodology for the CFATS program that incorporates the relevant elements of risk mandated by section 2102(e)(2) of title XXI of the Homeland Security Act of 2002 (as amended). The notice temporarily suspended and modified certain submission requirements for chemical facilities of interest and covered chemical facilities. Implementation of the improved tiering methodology required changes to an ICR published on July 14, 2016.

Implementation of the CFATS Personnel Surety Program
Published December 18, 2015. DHS informed Tier 1 and Tier 2 high-risk chemical facilities covered under CFATS of the implementation of the Personnel Surety Program. The notice provides information on statutory and regulatory history, options available for compliance, program requirements and details, Chemical Security Assessment Tool user roles and responsibilities, and privacy considerations.

CFATS Appendix A Notice of Public Meeting
Published October 16, 2015. DHS invited public comment and recommendations on how the Appendix A Chemicals of Interest (COI) list in the CFATS regulations may be improved. Along with the collection of written comments, DHS hosted a roundtable discussion and listening session on October 27, 2015.

CFATS: Guidance for the Expedited Approval Program
Published May, 13, 2015. DHS issued guidance to comply with the Protecting and Securing Chemical Facilities from Terrorist Attacks Act of 2014. The Act amended the Homeland Security Act of 2002 to require DHS to issue guidance for an Expedited Approval Program that identifies specific security measures sufficient to meet risk-based performance standards established as part of the CFATS regulations.

CFATS Advance Notice of Proposed Rulemaking (ANPRM)
Published on August 18, 2014. DHS initiated this rulemaking process as a step toward maturing the CFATS program and to identify ways to make the program more effective in achieving its regulatory objectives. This ANPRM provided an opportunity for the Department to hear and consider the views of interested members of the public, including regulated industry, on their recommendations for program modifications that could be incorporated into an updated CFATS regulation. The comment period was open through October 17, 2014.

DHS Request for Comment on CFATS Regulatory Provisions for Aboveground Gasoline Storage Tanks
Published on January 15, 2010. The Department invited public comment on issues related to certain regulatory provisions in CFATS that apply to facilities that store gasoline in aboveground storage tanks. The comment period was open through March 16, 2010.

Draft Risk-Based Performance Standards Guidance
Published on October 27, 2008. The Department invited public comment on the draft "Risk-Based Performance Standards" Guidance associated with CFATS. The comment period was open through November 26, 2008.

Clarification to Chemical Facility Anti-Terrorism Standards: Propane
Published March 21, 2008. This notice clarifies how certain provisions of CFATS apply to the Chemical of Interest (COI) propane, which is understood by the Department to contain at least 87.5% of the chemical propane. Specifically, this notice clarifies the STQ and counting rules that apply to the COI propane.

Agricultural Facilities Time Extension Notification
Published on January 9, 2008. The Department published a letter that it issued on December 21, 2007. Through this letter, the Department granted a time extension for farmers and other agricultural end-users who would otherwise have been required to submit a Top-Screen consequence assessment through the secure online Chemical Security Assessment Tool (CSAT) Top-Screen.

Chemical Security Assessment Tool (CSAT) Registration Reminder
Published April 25, 2007. The Department published a notice that recommended chemical facilities register to access the CSAT system. This is a voluntary registration process for facilities that think they may be covered by the Department’s CFATS (6 CFR Part 27), and that want to initiate the process to determine whether or not they are covered by 6 CFR Part 27.

CFATS Regulatory Evaluation
Published on April 9, 2007. This regulatory assessment was prepared in order to estimate the magnitude of cost chemical facility owners and/or operators would incur implementing CFATS Interim Final Rule (IFR).

Advance Notice of Proposed Rulemaking (ANPRM): Chemical Facility Anti-Terrorism Standards
Published December 28, 2006. Section 550 of the Homeland Security Appropriations Act of 2007 provided the Department with authority to promulgate “interim final regulations” for the security of certain chemical facilities in the United States. The Department developed and published this ANPRM, indicating that a new standard was under development and requesting public comments on the proposed rule. The comment period was open through February 7, 2007.

Chemical Security Assessment Tool (CSAT) ICR (1670-0007)

  • 30 Day Notice to solicit comments for OMB Collection #1670-0007. In this notice, CISA responds to one commenter who submitted multiple comments in response to the 60-day notice and revises the burden associated with an instrument (Identification of Additional Facilities and Assets at Risk). Published May 7, 2019.
  • 60 Day Notice to solicit comments for a revision to OMB Collection #1670-0007. This submission proposed to renew the information collection for an additional three years and update the burden estimates associated with collecting information in CSAT (i.e., User Registration, Top-Screen, Security Vulnerability Assessment, Site Security Plan and Alternative Security Program, etc.) for CFATS. Published February 07, 2019.

Current ICR Approved on July 14, 2016, and will Expire on July 31, 2019

This CSAT ICR revised the burden estimates for the instruments based on data collected since 2012 on how the tools are used. The revised estimate also accounts for the updates that the Department will be making to the questionnaires in order to implement the improved tiering methodology and incorporates the DHS estimates of the efficiencies that will be gained by the new, streamlined questionnaires.

Previous ICR Expired on 07/31/2016 (Extended from the initial expiration date of 04/30/2016)

This ICR revised the burdens for the instruments based upon historical data since the implementation of the collection. Several of the instruments were refined to reflect the maturing regulatory program. The Chemical-Terrorism Vulnerability Information (CVI) Training and User Authorization instrument was removed from this collection and remains only in the CVI collection (See 1670-0015).

Previous ICR Expired 05/31/2011

This ICR made a minor change to the CVI Authorization that did not affect the burden of the instrument. The minor change renamed the instrument to the CVI Training and Authorized User Application and removed the non-disclosure element in the instrument.

CFATS Personnel Surety Program ICR (1670-0029)

  • Notice of Action issued by OMB to the Department authorizing the collection of information for the phased implementation of the CFATS Personnel Surety Program at all high-risk chemical facilities. The complete information collection package may be found on the OMB website.
  • 30 Day Notice to solicit comments for a revision to OMB Collection #1670-0029. This information collection will allow high-risk chemical facilities to implement the CFATS Personnel Surety Program on Tier 3 and 4 facilities. Published June 18, 2018.
  • 60 Day Notice to solicit comments for a revision to OMB Collection #1670-0029. This information collection request notice is the first step in the process of gaining approval to allow high-risk chemical facilities to implement the CFATS Personnel Surety Program on Tier 3 and 4 facilities. In addition, this ICR notice revises the estimated number of annual respondents and the estimated time per respondent based upon historical data collected by the Department.
